Terms of Service
This is a translation provided for reference. The Japanese version is the official text, and the Japanese version shall prevail in the event of any discrepancy.
Article 1 (Application)
- These Terms of Use (these "Terms") set forth the conditions for using ITOSHIO, which is operated by ITOSHIO Inc. (hereinafter referred to as the "Store").
- Before placing an order, users of this site are requested to review these Terms and the terms of sale for each product.
Article 2 (Seller and Formation of Contract)
- The seller of each product is the Supplier displayed on the product page. For the Store's own products, the Store is the seller; for products of another company, that other company is the seller.
- A sales contract for a standard product is formed when the Supplier's notice of acceptance reaches the user. A contract is not formed merely by an order receipt notification or a card authorization. For products whose orders are accepted automatically, the contract is likewise formed when the notice of acceptance reaches the user.
- Individual conditions for subscriptions and the like are displayed in advance on the application screen. This site uses ECport provided by ITOSHIO Inc., but ITOSHIO Inc. is not the seller of the products.
Article 3 (Responsibilities of the Parties)
- The Supplier is responsible for the quality, legality, inventory, delivery, returns, and other matters relating to its products. The Store is responsible for operating the site, for its own representations and advertising, and for the initial handling of inquiries.
- This does not exempt the Store or ITOSHIO Inc. from liability in cases where grounds for liability are attributable to the Store or ITOSHIO Inc. itself.
Article 4 (Member Registration and Product Information)
- To make a purchase, users must register as members of this site and log in. Users must register accurate information and properly manage their login credentials.
- Prices, product details, shipping fees, delivery timing, the seller, and return conditions are displayed on the product page and the order confirmation screen. Colors and other aspects shown on screen may differ from the actual product; however, this does not limit users' rights with respect to any material discrepancy from what was displayed.
- Minors must obtain any required consent of their legal representative. Age-restricted products are subject to the conditions of each product.
Article 5 (Payment Methods and Timing of Payment)
- The available payment methods are credit card, as displayed on the order screen. Methods not offered on the site cannot be used.
- For card payments for standard products, the amount is reserved against the card's available credit when the order is placed, and the charge is finalized upon the Supplier's acceptance of the order. For the first payment of a subscription, certain digital products, and the like, payment is processed at the time displayed on the application screen.
- Payments are received by ITOSHIO Inc. through payment service providers and distributed to Suppliers and other parties. Once a payment has been duly received by the designated method, payment to the seller is complete to the extent of that amount, and users will not be charged twice solely on the grounds of a delay in distribution.
Article 6 (Delivery and Purchases from Overseas)
- Products are shipped or provided by the Supplier or a party arranged by the Supplier in accordance with the displayed conditions. Products are not shipped until payment has been completed.
- If a delivery delay or other issue occurs, please contact the Supplier or the Store.
- When using a proxy purchasing service such as Buyee, users are requested to review that service's purchase, delivery, and return conditions. Customs duties, import regulations, and deliverable regions are subject to the purchase conditions.
Article 7 (Returns, Exchanges, and Cancellations)
- Returns and cancellations for the purchaser's own reasons are subject to the return conditions displayed before purchase. Orders that can be canceled before acceptance can be canceled through My Page or the like. For orders that cannot be canceled automatically, such as the first payment of a subscription that has already been charged, please contact the inquiry desk.
- In cases of non-conformity with the contract, such as defective products, non-provision, or incorrect delivery, the Supplier will respond in accordance with applicable laws and regulations. Where an entire order is canceled for reasons attributable to the Supplier, the full price of the affected items, including shipping fees, will be refunded; where an order is partially canceled, the price of the affected portion and the corresponding costs will be refunded.
- When a refund is made, no new payment processing fees or similar charges will be added after purchase and deducted from the refund amount. Rights of cancellation, rescission, refund, and the like under applicable laws are not restricted by these Terms or the return conditions.
- If a refund cannot be made by the usual method, the refund will be made by bank transfer or other means after confirming the processing status and verifying the user's identity and account. Fees for such alternative refunds will not be deducted from the refund amount.
- Whether a refund is available and the amount of any refund are determined based on the prescribed conditions and applicable laws and regulations. Necessary refunds will not be left unaddressed on the grounds of internal settlements between the Store and the Supplier.
Article 8 (Inquiries)
- Users may contact the Supplier listed on the product page directly regarding product specifications, delivery, returns, and other matters.
- The Store also receives initial inquiries at its contact address ([email protected]) and forwards them to the Supplier as necessary. Merely forwarding an inquiry does not exempt the Store from its own responsibility.
Article 9 (Prohibited Acts and Restrictions on Use)
- Fraudulent orders, false registration, unauthorized access, interference with the system, infringement of rights, and violations of laws and regulations are prohibited.
- In the event of a violation or a specific suspicion of fraud, the Store will restrict use to the extent necessary and, in principle, will notify the user of the reason. In an emergency, the Store will notify the user promptly after the fact.
- A restriction on use alone will not result in the blanket forfeiture of rights such as the right to claim a refund for a lawful order.
Article 10 (Liability and Statutory Rights)
- If the Store causes damage to a user due to grounds attributable to the Store, the Store will be liable in accordance with applicable laws and regulations.
- The fact that the seller of a product is a different Supplier does not relieve the Store of its liability for its own representations, advertising, handling, and the like. Any exemption from liability or restriction of rights that is contrary to the Consumer Contract Act or other mandatory laws and regulations will not apply.
Article 11 (Amendment of These Terms and Governing Law)
- These Terms will be amended with the agreement of users or where the requirements for amending standard terms (teikei yakkan) under the Civil Code are met. The details of the amendment and its effective date will be announced in advance.
- These Terms are governed by the laws of Japan. Disputes will be resolved by a court having jurisdiction under applicable laws and regulations, and this does not prejudice users' rights protected by mandatory laws and regulations.
